LA CRIMINOLOGÍA RELACIONADA COMO HERRAMIENTA EN EL CÓDIGO ORGÁNICO PROCESAL PENAL Y EN EL CÓDIGO PENAL: Related Criminology as a Tool in the Organic Code of Criminal Procedure and in the Penal Code

Resumen

La criminología es una ciencia penal auxiliar que mediante la
aplicación de sus conocimientos científicos y metodológicos induce
evidencias certeras cuando se presume que se ha cometido un hecho
punible. La Criminología según “Sandoval Smart 1960”, dice que “la
Criminología es la disciplina auxiliar del derecho penal que se ocupa
del descubrimiento y verificación científica del delito y del delincuente”.
El criminólogo “Rodríguez Manzanero 1926” define “La criminalística
como el conjunto de conocimiento aplicables a la búsqueda,
descubrimiento y verificación científica de un delito en particular y en el
estudio del presunto responsable”, aquí vamos a la búsqueda de la
criminología y la posición psicológica del delincuente.

ABSTRACT

Criminology is an auxiliary criminal science that, through the application
of its scientific and methodological knowledge, induces accurate
evidence when it is presumed that a punishable act has been
committed.
