EL ADN Y SU IMPORTANCIA EN LA INVESTIGACIÓN JUDICIAL: DNA and its importance in judicial investigation

Resumen

En el presente artículo de investigación se abordará la temática del
ADN y su importancia en las investigaciones judiciales, explicando que
a partir de adelantos científicos y tecnológicos, se ha logrado alcanzar
un progreso, contribuyendo de esta manera a mejorar la calidad de
vida de las personas, seguridad social y también el afianzamiento de
los derechos y deberes ciudadanos, En general las muestras
biológicas se refieren a las muestras materiales como sangre, tejido,
células, ADN, ARN o proteínas de seres humanos, animales o plantas.
Estas muestras son utilizadas para pruebas de laboratorio o bien son
almacenadas en un depósito biológico para poder usarse en una
investigación, en este caso solo se estudiará la utilización del análisis
de prueba de Ácido Desoxirribunocleico (ADN) en las investigaciones
judiciales, teniendo en cuenta que, con el pasar de los años ha
adquirido gran importancia en cuanto a su aporte para resoluciones de
juicios civiles y penales, al igual que en la identificación de cadáveres.
La técnica que se utilizó en la investigación fue la observación
documental dado que la recolección de datos se encontró en material
tanto bibliográfico como electrónico, también en la revisión y resumen
de textos legales (leyes, reglamentos y jurisprudencias) consultadas
sobre el tema objeto de estudio, con lo cual se logró obtener un
análisis de contenido en esta investigación documental, lo que permite
concluir la relevancia que tiene la utilización de estos análisis de ADN,
en las investigaciones judiciales, su valoración probatoria y la
trascendencia que revisten para la determinación de la identidad y
filiación de las personas bajo el marco jurídico venezolano.
 
Abstract

In this research article, the topic of DNA and its importance in judicial
investigations will be addressed, explaining that progress has been
achieved through scientific and technological advances, thus
contributing to improving people's quality of life. , social security and
also the strengthening of citizen rights and duties. In general, biological
samples refer to material samples such as blood, tissue, cells, DNA,
RNA or proteins from human beings, animals or plants. These samples
are used for laboratory tests or are stored in a biological repository to
be used in an investigation. In this case, only the use of the
Deoxyrribunocleic Acid (DNA) test analysis in judicial investigations will
be studied, taking into account that, over the years it has acquired great
importance in terms of its contribution to resolutions of civil and criminal
trials, as well as in the identification of corpses. The technique used in
the research was documentary observation given that the data
collection was found in both bibliographic and electronic material, also
in the review and summary of legal texts (laws, regulations and
jurisprudence) consulted on the topic under study, with which it was
possible to obtain a content analysis in this documentary investigation,
which allows us to conclude the relevance of the use of these DNA
analyzes in judicial investigations, their evidentiary assessment and the
significance they have for determining the identity and affiliation of
people under the Venezuelan legal framework.
