MARCO JURÍDICO VENEZOLANO DEL PROCEDIMIENTO DE LEVANTAMIENTO DEL CADÁVER EN LA MEDICINAL LEGAL: VENEZUELAN LEGAL FRAMEWORK OF THE CORPSE REMOVAL PROCEDURE IN LEGAL MEDICINAL

Resumen

El procedimiento de levantamiento del cadáver en los casos por deceso bajo
circunstancias violentas forma parte fundamental de la medicina legal y de las
investigaciones forenses. Esto se debe a que el cadáver puede contener evidencias de
suma importancia, como lo pueden ser las heridas, los rastros biológicos, entre otros;
permite determinar la causa y modo de muerte de la víctima y contribuye a la protección
del lugar de los hechos. El marco jurídico que regula estos procedimientos se encuentra
conformado por las siguientes leyes: El Código Orgánico Procesal Penal, la Ley Orgánica
del Poder Judicial y el Código de Deontología Medica de Venezuela, las cuales se
encargan de garantizar que el procedimiento de levantamiento del cadáver sea realizado
de forma exitosa y a su vez contribuya con a la justicia, la resolución de asuntos penales,
y el esclarecimiento de los hechos.

Abstract
The procedure for removing the body in cases of death under violent circumstances is a
fundamental part of legal medicine andforensic investigations. This is because the corpse may
contain extremely important evidence, such as wounds, biological traces, among others; It
allows determining the cause and manner of death of the victim and contributes to the
protection of the scene. The legal framework that regulates these procedures is made up of the
following laws: The Organic Code of Criminal Procedure, the Organic Law of the Judiciary and
the Code of Medical Ethics of Venezuela, which are responsible for guaranteeing that the
procedure for removing the corpse is carried out successfully and in turn contributes to justice,
the resolution of criminal matters, and the clarification of the facts.
