PRINCIPIOS Y GARANTÍAS CONSTITUCIONALES EN LA FASE INTERMEDIA DEL PROCESO PENAL VENEZOLANO: CONSTITUTIONAL PRINCIPLES AND GUARANTEES IN THE INTERMEDIATE PHASE OF THE VENEZUELAN CRIMINAL PROCESS

Resumen

Principios y garantías constitucionales que se deben llevar a cabo en la Fase Intermedia del
Proceso Penal Venezolano, se encuentra adscrito a la línea de investigación penal y procesal
constitucional, a tal punto que, nuestro objetivo principal para la realización de este trabajo se
fundamenta en torno a determinar de manera clara y precisa cada uno de los principios y
garantías que se llevan a cabo en la fase intermedia del proceso penal venezolano. En tal
sentido, abordaremos la disyuntiva que se lleva a cabo en el pleno contexto del sistema
acusatorio venezolano, y, de la misma forma, indagaremos en el apartado sistema inquisitivo,
ya que, en el mismo, se contemplan los vicios y las envergaduras con las que trabajó el anterior
sistema judicial. Del estudio realizado, explicitaremos un análisis bastante exhaustivo en
función de las garantías y principios que rigen la fase intermedia del proceso penal venezolano,
con el propósito de exaltar la naturaleza jurídica dentro del nuevo proceso penal venezolano
y, por ende, partiremos de un análisis e interpretación de una serie de documentos como
doctrinas, jurisprudencia y ordenamiento jurídico de la legislación venezolana.

Abstract
Constitutional principles and guarantees that must be carried out in the Intermediate Phase of
the Venezuelan Criminal Process, is attached to the line of constitutional criminal and
procedural investigation, to such an extent that our main objective for the realization of this
work is based on, clearly and precisely determine each of the principles and guarantees that
are carried out in the intermediate phase of the Venezuelan criminal process. In this sense, we
will address the dilemma that takes place in the full context of the Venezuelan accusatory
system, and, in the same way, we will investigate the inquisitive system section, since, in it, the
vices and the magnitudes with which the previous judicial system worked. From the study
carried out, we will explain a fairly exhaustive analysis based on the guarantees and principles
that govern the intermediate phase of the Venezuelan criminal process, with the purpose of
exalting the legal nature within the new Venezuelan criminal process and, therefore, we will
start from an analysis and interpretation of a series of documents such as doctrines,
jurisprudence and legal system of Venezuelan legislation.
