AMPARO CONSTITUCIONAL COMO MEDIO CONTRA LA VIOLACIÓN DEL DERECHO A LA DEFENSA Y EL DEBIDO PROCESO EN VENEZUELA

El amparo constitucional tiene por objeto asegurar el goce y ejercicio de los derechos y garantías constitucionales establecidas en la Constitución, leyes y tratados internacionales, condenando acciones de los agresores, tendente únicamente a la constatación de la violación del derecho o garantía constitucional, a objeto de que se le restablezca al solicitante el pleno goce. Del anterior planteamiento se desprende el objetivo de la investigación el cual es comprender el amparo constitucional como medio contra la violación del derecho a la defensa y el debido proceso en Venezuela. Esta se llevó acabo aplicando el método jurídico dogmático, de tipo documental con un diseño bibliográfico, se aplicó el fichaje de información bibliográfica, hemerográfica y referenciales y las técnicas para el análisis de la información fueron la observación documental, presentación resumida, resumen analítico y análisis crítico. Parte de los resultados fue que la acción de amparo constitucional está concebida como una protección de derechos y garantías constitucionales, por lo que el ejercicio de la acción está reservado para restablecer situaciones que provengan de las violaciones de tales derechos y garantías; una de las conclusiones establecidas es que los derechos y garantías constitucionales no involucran directamente nulidades, ni indemnizaciones, sino que otorgan situaciones jurídicas esenciales al ser humano.

Abstract

The purpose of constitutional protection is to ensure the enjoyment and exercise of the constitutional rights and guarantees established in the Constitution, laws and international treaties, condemning actions of the aggressors, aimed only at verifying the violation of the right or constitutional guarantee, in order to that full enjoyment be restored to the applicant. From the previous approach, the objective of the investigation emerges, which is to understand constitutional protection as a means against the violation of the right to defense and due process in Venezuela. This was carried out by applying the dogmatic legal method, of a documentary type with a bibliographic design, the recording of bibliographic, newspaper and reference information was applied and the techniques for the analysis of the information were documentary observation, summary presentation, analytical summary and analysis critical. Part of the results was that the constitutional protection action is conceived as a protection of constitutional rights and guarantees, so the exercise of the action is reserved to restore situations that arise from violations of such rights and guarantees; One of the established conclusions is that constitutional rights and guarantees do not directly involve nullities or compensation, but rather grant essential legal situations to human beings.

APRENDIZAJE SIN DISTANCIA A PARTIR DE LAS RESTRICCIONES SANITARIAS DEL COVID-19: EL APORTE DEL LABORATORIO DE APRENDIZAJE A: LAB

Resumen

Este proceso se desarrolla en el marco del paradigma cualitativo mediante la sistematización a manera retrospectiva. Muestra un artículo teórico derivado de una experiencia didáctica. Su objetivo es evidenciar las estrategias desarrolladas para atender la emergencia sanitaria por COVID-19 por parte del Laboratorio de aprendizaje, las cuales buscan promover una educación superior de calidad en presencia virtual, a través de relaciones cercanas y acompañamiento pedagógico estratégico. Se espera que estas experiencias y lecciones aprendidas sean un insumo valioso para otras comunidades educativas, permitiendo crear redes de aprendizaje dinámicas y SIN distancia. Los participantes corresponden a la comunidad de aprendizaje de la Universidad, es decir, docentes, estudiantes, y personas colaboradoras que participan activamente de las acciones planteadas. Metodología. Las estrategias de recolección de datos utilizadas fueron la observación participante, talleres, entrevistas con grupos focales, línea del tiempo y conversatorios pedagógicos entre los investigadores. Como principales hallazgos del proceso, se reconoce que, el contar con un modelo ecoformativo establecido, así como esfuerzos importantes previo a la pandemia para fortalecer la cercanía y solidaridad en todos los procesos de aprendizaje y de gestión administrativa, son clave para un tránsito seguro de la presencia física a la virtual, lo cual permitiría contrarrestar la visión de isla con el trabajo colaborativo y articulado como elemento clave para comprender el modelo educativo y, sobre todo, vivenciado por la comunidad de aprendizaje. Abstract

This process is developed within the framework of the qualitative paradigm through retrospective systematization. Shows a theoretical article derived from a didactic experience. Its objective is to demonstrate the strategies developed to address the COVID-19 health emergency by the Learning Laboratory, which seek to promote quality higher education in virtual presence, through close relationships and strategic pedagogical support. It is expected that these experiences and lessons learned will be a valuable input for other educational communities, allowing the creation of dynamic learning networks WITHOUT distance. The participants correspond to the learning community of the University, that is, teachers, students, and collaborators who actively participate in the proposed actions. Methodology. The data collection strategies used were participant observation, workshops, focus group interviews, timeline and pedagogical conversations between researchers. As the main findings of the process, it is recognized that having an established eco-training model, as well as important efforts prior to the pandemic to strengthen closeness and solidarity in all learning and administrative management processes, are key to a safe transit of physical to virtual presence, which would allow us to counteract the island vision with collaborative and articulated work as a key element to understand the educational model and, above all, experienced by the learning community. Resumen

En Cuba, la literatura ha sido desde los inicios de la formación del ser nacional muestra de la expresión identitaria del pueblo. Ha revelado el sentir personal de cada autor. Recrear su arte, ha permitido a través de la destreza literaria mostrar la identificación con el terruño. El trabajo que se presenta posee como objetivo: realizar un análisis de cómo se formó la conciencia identitaria en Cuba, en la fecha que abarca desde su descubrimiento y hasta la primera mitad del siglo XIX.

Abstract

In Cuba, literature has been, since the beginning of the formation of the national being, an example of the identity expression of the people. It has revealed the personal feelings of each author. Recreating his art has allowed, through literary skill, to show identification with the land. The objective of the work presented is to carry out an analysis of how identity consciousness was formed in Cuba, from the date of its discovery until the first half of the 19th century

IMPORTANCIA DE LOS MÉTODOS DE AVANZADA PARA LA INVESTIGACIÓN EMPRESARIAL

El mundo empresarial en la actualidad, se ha vuelto cada vez más complejo en todas sus dimensiones. Esta realidad ha hecho más difícil los procesos metodológicos para conocerla en profundidad, conocimiento requerido para lograr el progreso de la sociedad. De aquí, ha ido naciendo, en los últimos 30 años, una gran diversidad de métodos, estrategias, procedimientos, técnicas e instrumentos, principalmente en las ciencias humanas, para abordar y enfrentar esta compleja realidad. Estos procesos metodológicos se conocen hoy como Metodologías Cualitativas. El propósito del presente ensayo es analizar la importancia de los métodos de avanzada para la investigación empresarial. La metodología corresponde a una investigación documental, con un arqueo heurístico de fuentes bibliográficas. La indagación reveló que la investigación cualitativa pueda ser tan válida como la cuantitativa. La investigación cualitativa emerge para afrontar situaciones problemáticas que no se pueden comprender desde el enfoque cuantitativo. La investigación empresarial requiere de los paradigmas naturalistas, interpretativos o fenomenológicos para analizar sucesos, significados e interacciones que se originan en las relaciones empresariales, comportamientos de los humanos en las empresas u organizaciones, las decisiones tomadas en determinadas circunstancias, los contextos económicos de los negocios que afectan las decisiones; en estos casos es indispensable utilizar metodologías cualitativas que permitan analizar dichas particularidades. Abstract

Nowadays, the business world has become increasingly complex in all its dimensions. This reality has made the methodological processes more difficult to understand it in depth, knowledge required to achieve the progress of society. From here, in the last 30 years, a great diversity of methods, strategies, procedures, techniques and instruments have been born, mainly in the human sciences, to address and confront this complex reality. These methodological processes are known today as Qualitative Methodologies. The purpose of this essay is to analyze the importance of advanced methods for business research. The methodology corresponds to a documentary investigation, with a heuristic analysis of bibliographic sources. The investigation revealed that qualitative research can be as valid as quantitative research. Qualitative research emerges to address problematic situations that cannot be understood from the quantitative approach. Business research requires naturalistic, interpretive or phenomenological paradigms to analyze events, meanings and interactions that originate in business relationships, human behaviors in companies or organizations, decisions made in certain circumstances, the economic contexts of business that affect decisions. In these cases, it is essential to use qualitative methodologies that allow these particularities to be analyzed. CULTURA DE PAZ Y CONVIVENCIA SOLIDARIA EN CONTEXTOS UNIVERSITARIOS. UNA VISIÓN COMPARTIDA

La cultura de paz y convivencia solidaria en contextos universitarios implica promover valores de respeto, colaboración y solidaridad, fomentando la participación activa de todos los miembros de la comunidad universitaria en la construcción de una sociedad más justa y pacífica. De allí que el articulo tiene como objetivo divulgar los hallazgos sobre la cultura de paz y convivencia solidaria en contextos universitarios desde la visión de los actores educativos y socio-securitarios. Metodológicamente, se trató de una investigación de campo, de corte cualitativa,de nivel descriptivo, empleando como método la etnografía, y como técnica de recolección de información la entrevista no estructurada y como instrumento un guión de preguntas, grabador del celular, realizada a seis (06) informantes clave: 2 docentes, 2 estudiantes y 2 funcionarios policiales del escenario de estudio seleccionado campus UCV-Maracay, como hallazgos principales emergen que existen debilidades en la integración de los cuadrantes de paz y la comunidad universitaria, lo cual obstaculiza que se conforme una cultura de paz para una armónica convivencia solidaria. Se concluye la necesidad de acciones estratégicas para la vinculación entre los actores educativos - securitarios. Se recomienda impulsarla desde las dimensiones políticas, jurídicas, educativas, sociales y espirituales. Abstract

The culture of peace and supportive coexistence in university contexts involves promoting values of respect, collaboration and solidarity, encouraging the active participation of all members of the university community in the construction of a more just and peaceful society. Hence, the article aims to disseminate the findings on the culture of peace and supportive coexistence in university contexts from the perspective of educational and socio-safe actors. Methodologically, it was a field investigation, qualitative in nature, at a descriptive level, using ethnography as a method, and an unstructured interview as an information collection technique and as an instrument a script of questions, a cell phone recorder, carried out with six . (06) key informants: 2 teachers, 2 students and 2 police officials from the selected study scenario UCV-Maracay campus, as the main findings emerge that there are weaknesses in the integration of the peace quadrants and the university community, which hinders that form a culture of peace for a harmonious coexistence of solidarity. The need for strategic actions for the link between educational and security actors is concluded. INNOVACIÓN DISRUPTIVA: EL MOTOR OCULTO DEL DESARROLLO ECONÓMICO SOSTENIBLE

La innovación disruptiva es un concepto que ha tomado gran relevancia en los últimos años, especialmente en el ámbito económico. Se refiere a la introducción de nuevas tecnologías, productos o servicios que cambian radicalmente la forma en que se hacen las cosas en una industria. El objetivo de esta investigación es orientar sobre la innovación por ser beneficiosa para el desarrollo económico sostenible, ya que permite la creación de nuevos mercados y la mejora de la eficiencia y productividad. En este sentido, la innovación disruptiva es vista como un motor oculto del desarrollo económico sostenible, por impulsar el crecimiento y la competitividad de una empresa o incluso de todo un país. Sin embargo, para que tenga éxito, es necesario contar con un ecosistema adecuado que fomente la creatividad y el emprendimiento, es decir una inversión en investigación y desarrollo, cultura empresarial que valore la experimentación y el aprendizaje. Disruptive innovation is a concept that has gained great relevance in recent years, especially in the economic field. It refers to the introduction of new technologies, products or services that radically change the way things are done in an industry. The objective of this research is to guide innovation as it is beneficial for sustainable economic development, since it allows the creation of new markets and the improvement of efficiency and productivity. In this sense, disruptive innovation is seen as a hidden driver of sustainable economic development, for boosting the growth and competitiveness of a company or even an entire country. However, for it to be successful, it is necessary to have an adequate ecosystem that encourages creativity and entrepreneurship, that is, an investment in research and development, a business culture that values experimentation and learning. INTERPRETACIONES CONTABLES DIVERGENTES: EL PAPEL DEL JUICIO PROFESIONAL Y LAS REFLEXIONES FILOSÓFICAS

Los efectos de las interpretaciones contables divergentes cuando se aplica el juicio profesional en las interpretaciones contables divergentes en el contexto de la Norma Internacional de Información Financiera para Pequeñas y Medianas Empresas (NIIF para Pymes). Recorro las diversas secciones de la NIIF para Pymes donde se hace referencia al juicio profesional, y se analizan los efectos que estas interpretaciones divergentes pueden tener en la calidad y comparabilidad de la información financiera. También examino las perspectivas filosóficas de Kant y Aristóteles para intentar obtener una mejor comprensión sobre los fundamentos éticos y conceptuales detrás del juicio profesional contable. A través de algunos ejemplos prácticos, mostraré cómo el juicio profesional puede influir en decisiones clave relacionadas con políticas contables, estimaciones, clasificación de instrumentos financieros, valoración de inventarios y gastos por intereses y los posibles impactos de estas divergencias en la confianza y la transparencia de la información financiera Se concluye que es fundamental que los contadores públicos ejerzan un juicio profesional responsable, considerando los principios éticos y las directrices establecidas en la NIIF para Pymes, a fin de garantizar la calidad y confiabilidad de la información financiera para los usuarios. Abstract

The effects of divergent accounting interpretations when professional judgment is applied to divergent accounting interpretations in the context of the International Financial Reporting Standard for Small and Medium-sized Enterprises (IFRS for SMEs). I go through the various sections of the IFRS for SMEs where professional judgment is referred to, and the effects that these divergent interpretations can have on the quality and comparability of financial information are analyzed. I also examine the philosophical perspectives of Kant and Aristotle to attempt to gain a better understanding of the ethical and conceptual foundations behind professional accounting judgment. Through some practical examples, I will show how professional judgment can influence key decisions related to accounting policies, estimates, classification of financial instruments, inventory valuation and interest expenses and the possible impacts of these divergences on the trust and transparency of financial information It is concluded that it is essential that public accountants exercise responsible professional judgment, considering the ethical principles and guidelines established in the IFRS for SMEs, in order to guarantee the quality and reliability of financial information for user Keywords: Divergent accounting interpretations, Professional judgment, IFRS for SMEs

PROSPECTIVA HERRAMIENTA COMPLEMENTARIA DEL PROCESO DE PLANIFICACIÓN EN LAS ORGANIZACIONES CON VISIÓN DE FUTURO.

El objetivo de este artículo es abordar el tema de la prospectiva como herramienta complementaria del proceso de planificación en las organizaciones, para lo cual se hace una actividad interpretativa para captar el significado del constructo prospectiva, su origen, tipos, características y como herramienta de apoyo al proceso de la planificación y toma de decisiones. Apoyado en una metodología documental de corte hermenéutico, que permitió ampliar, profundizar el tema y facilitar su posterior análisis.La reflexión acerca Del análisis de las fuentes nos lleva a confirmar que la prospectiva es una herramienta de construcción de propuestas, agendas o proyectos de futuros, basada en el pensamiento complejo y sistémico, apoyado en la ciencia, de carácter adaptativo, en su evolución ha ganado un status relevante en la toma de decisiones, actualmente representa un complemento del proceso de planificación.El recurso humano que forma parte de la organización juega un papel relevante, los tomadores de decisiones no pueden ser mentalmente de corto plazo, deben tener visión de futuro, de anticipar, innovar y de motivar, se requiere entonces de inversión y desarrollo de este atributo organizacional para enfrentar la incertidumbre del futuro. Abstract

The objective of this article is to address the issue of prospective as a complementary tool to the planning process in organizations, for which an interpretive activity is carried out to capture the meaning of the prospective construct, its origin, types, characteristics, and as a support tool, to the planning and decision-making process. Supported by a documentary methodology of a hermeneutic nature, which allowed to expand, deepen the subject and facilitate its subsequent analysis. Foresight is a tool for building proposals, agendas or future projects, based on complex and systemic thinking, supported by science, of an adaptive nature, in its evolution it has gained relevant status in decision-making, currently it represents a supplement to the planning process. The human resources that are part of the organization play a relevant role, decision makers cannot be mentally short-term, they must have a vision of the future, to anticipate, innovate and motivate, investment and development of this attribute are then required organization to face the uncertainty of the future.
